Acceptance of Terms

Welcome to ApexForgeres. These Terms of Service ("Terms") govern your use of the ApexForgeres website located at apexforgeres.pro and our remote team management services (collectively, the "Service") operated by ApexForgeres AS ("us", "we", or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service. These Terms constitute a legally binding agreement between you and ApexForgeres AS.

Your acceptance of these Terms creates a legal agreement between you and ApexForgeres AS, a Norwegian company registered under registration number 851462395, with its registered office at Bygdøy allé 137, 4061 Stavanger, Rogaland, Norway.

Description of Service

ApexForgeres provides remote team management tools and services designed to help businesses optimise their distributed workforce operations. Our services include but are not limited to collaboration platforms, performance analytics, security solutions, and support services for remote teams.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice, and without liability to you or any third party.

User Accounts and Registration

To access certain features of our Service, you may be required to create an account. When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password and for maintaining the confidentiality of your account.

You agree to accept responsibility for all activities that occur under your account or password. You must notify us immediately upon becoming aware of any breach of security or unauthorised use of your account.

User Obligations and Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

The Service and its original content, features, and functionality are and will remain the exclusive property of ApexForgeres AS and its licensors. Payment Terms and Billing

All fees are non-refundable unless otherwise stated in your service agreement. We reserve the right to change our pricing at any time, with reasonable notice provided to existing customers.

If you fail to pay any fees when due, we may suspend or terminate your access to the paid aspects of the Service until payment is made.

Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices regarding the collection and use of your personal information.

By using the Service, you consent to the collection and use of your information in accordance with our Privacy Policy and applicable data protection laws, including the General Data Protection Regulation (GDPR).

Limitation of Liability

To the fullest extent permitted by applicable law, ApexForgeres AS, its directors, employees, partners, agents, suppliers, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

In no event shall ApexForgeres AS's total liability to you for all damages, losses, and causes of action exceed the amount you have paid to ApexForgeres AS in the twelve (12) months preceding the claim, or €100, whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. In such jurisdictions, our liability will be limited to the fullest extent permitted by law.

The information on this website is provided on an "as is" basis. To the fullest extent permitted by law, ApexForgeres AS excludes all representations, warranties, conditions, and terms whether express or implied by statute, common law, or otherwise.

We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that defects will be corrected. We make no warranties about the accuracy, reliability, completeness, or timeliness of the content, services, software, text, graphics, and links.

Indemnification

You agree to defend, indemnify, and hold harmless ApexForgeres AS and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to legal fees).

Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

Upon termination, your right to use the Service will cease immediately. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Norway, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Norway, and you consent to the jurisdiction of such courts.

If you are a consumer resident in the European Union, you may also have the right to bring proceedings in the courts of your country of residence, and nothing in these Terms affects your rights as a consumer under applicable consumer protection laws.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Service.

Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.
